Comprehensive Agreement Governing Services, Orders, and Customer Relations
1. Introduction
These Terms and Conditions (“Agreement”) govern all transactions, services, and interactions between the customer (“Client”, “You”, or “Your”) and Siphosethu Creations Pty Ltd (“Company”, “We”, “Us”, or “Our”), relating to the design, printing, and sale of customized tumblers and related products. By engaging in business with us, you agree to be bound by these terms. Please read them carefully before placing any orders.
2. Scope of Services
We provide personalized tumbler printing and related design services. The Client may request customization based on supplied or company-provided designs, subject to our review and approval.
· We reserve the right to refuse any design or request that violates copyright laws, includes offensive material, or does not meet our quality standards.
· Design consultations, proofs, and revisions are offered as specified in individual service packages.
3. Orders and Acceptance
· All orders must be submitted through our official channels (website, email, or in-person, as specified by us).
· Orders are deemed accepted only upon written or electronic confirmation from us.
· Order details, including quantities, designs, and specifications, must be accurate and confirmed by the Client at the time of order placement.
4. Pricing and Payment
· All prices are listed in Rands and are subject to change without prior notice.
· Quotes provided are valid for [number] days from the date of issue, unless otherwise specified.
· Full payment or a deposit (as specified in the quote) is required prior to commencement of printing.
· Accepted payment methods include [list methods, e.g., credit card, bank transfer, PayPal].
· Orders will not be processed until payment is received and cleared.
5. Design and Artwork
· You must ensure that any artwork, logos, or images provided do not infringe third-party copyright, trademarks, or intellectual property rights.
· We may decline to print designs that, in our sole discretion, are unlawful, offensive, or likely to bring the Company into disrepute.
· We offer a proofing process for all custom designs. The Client is responsible for reviewing and approving proofs before final production.
· Once a proof is approved, changes may not be possible or may incur additional charges.
6. Production and Turnaround Time
· Standard production times are [number] business days from final proof approval and payment receipt. Large or complex orders may require additional time.
· Rush orders may be accommodated at our discretion and may incur additional fees.
· Production timelines may be affected by factors outside our control (e.g., supply shortages, delays in artwork approval, force majeure), for which we are not liable.
7. Shipping and Delivery
· Shipping options, costs, and estimated delivery times will be provided at the time of order.
· We are not responsible for delays caused by third-party shipping providers.
· Risk of loss passes to the Client upon delivery to the carrier.
· Customers are responsible for providing accurate delivery information. We are not liable for lost or delayed shipments due to incorrect or incomplete addresses.
8. Cancellations and Changes
· Orders may be cancelled or changed within 48 hours of order confirmation, provided that production has not commenced.
· Custom or personalized orders cannot be cancelled once production has started.
· Any approved cancellations may be subject to a cancellation fee to cover administrative and material costs.
9. Returns, Refunds, and Exchanges
· Due to the personalized nature of our products, returns and refunds are only accepted for items that are defective, damaged, or do not match the approved proof.
· Claims for defective or incorrect products must be made within 7 days of delivery, with supporting photographic evidence.
· We reserve the right to inspect and verify any claim before issuing a replacement or refund.
· Minor variations in color, positioning, or print outcome are possible due to the custom nature of printing and are not grounds for return.
10. Intellectual Property
· All original designs, templates, and proprietary processes created by us remain the intellectual property of Siphosethu Creations Pty Ltd unless explicitly transferred in writing.
· The Client warrants they have the legal rights to use any material provided to us.
11. Limitation of Liability
· Our liability is limited to the value of the goods or services supplied.
· We are not liable for any indirect, incidental, or consequential damages arising from the use, misuse, or inability to use our products.
· Clients are responsible for the suitability and safe use of our products.
12. Privacy and Data Protection
· We respect your privacy and handle your personal information in accordance with applicable data protection laws.
· Your information will only be used to process orders, provide services, and, if you consent, deliver marketing communications.
· We do not sell or disclose your personal information to third parties except as required by law or necessary for order fulfillment.
13. Force Majeure
We are not responsible for any delays or failure to perform due to causes beyond our reasonable control, such as natural disasters, government action, epidemics, war, strikes, or supply chain disruptions.
14. Governing Law and Jurisdiction
This Agreement is governed by the laws of South Africa, Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in South Africa
15. Changes to Terms and Conditions
We reserve the right to update or modify these Terms and Conditions at any time. The most current version will be posted on our website. Continued use of our services constitutes acceptance of any revised terms.
